Guide to Completing the Surface Land Compensation Summary

 

General Guidelines -  Every field on the form should contain data except breakdown items where appropriate.  Some fields are required and must be completed.  The First Year amount is a required field, please ensure that the number is consistent with the ‘heads of compensation’.  For a rent review the First Year field should be set to zero.  The Land Value field should be completed for all leases except Rent Reviews and Consent of Occupant.

 

CONTACT  - Name of the person that we should contact if we have any questions about the information contained on the form.  Generally, this will be the person filling out the form.

 

PHONE - Phone number of the contact person.   COMPANY - Name of the company that employs the contact.

 

PROVINCE - Province in which the lease resides.

 

ACQUISITION TYPE – Select one to show if this is the taking of a new lease, or a rent review or an amendment to a lease (eg. when lease compensation is reduced for an abandoned well.)

 

LOCATION - Enter the precise location of the lease including legal sub division and section.  When describing pipelines please enter the LSD at one end of the pipe.  If the pipeline crosses into another township then please put both ends in with the appropriate acreage.  If there is different compensation paid on the different ROWs then they all should be included.

 

AREA - The number of acres covered by the lease.

 

LEASE TYPE – Select one to describe the type of lease.  Compensation determined by a Surface Rights Board hearing should select 'Board Order'.  Crown lands requiring a payment to the current surface lessee should select "Consent of Occupant'.

 

LEASE USAGE - Select one to describe the usage of the leased area by the operator.  Select 'Access Road' if the lease is for an access road only.

 

EFFECTIVE DATE  - Enter the date at which the lease becomes effective.

 

OPERATOR - The name of the operator who is leasing the surface.

 

LAND USAGE - Select one to describe the agricultural use of the land.  Where there are several uses for the land check the one which had the most influence on the level of compensation paid.

 

LOCATION - Select one box to describe the location of the lease.  'Home Quarter' should take precedence over 'Inside Field' or 'Boundary Line'.

 

BREAKDOWN - Enter the amounts paid under the heads of compensation including 'Other' as itemized on the Surface Lease Agreement.  If there are any other payments made that are not on the Lease Agreement, these should be reported as 'Additional Payments' and a comment provided to further explain the payment.  Note: do not include the Alberta Entry Fee under 'Other' or 'Additional Payments', or in the 'Total First Year'.

 

PROBLEMS – If you obtain a “Cannot update the database” Error message it means that that lease is already in the database.  Please check the legal description.
